Terms of Service
These terms are an agreement between you and DeeMusiq, a venture of The Dembe Group, based in KwaZulu-Natal, South Africa ("DeeMusiq", "we", "us"). By installing the DeeMusiq app or using its online features, you agree to them. If you do not agree, do not use the service.
1. The service
DeeMusiq is a music app for streaming, downloading and playing audio. Core playback works offline; optional online features (accounts, the token wallet, purchases and linked accounts) connect to a DeeMusiq backend service. We may add, change or withdraw features as the platform develops.
2. Accounts
Online features use an account bound to your device. You are responsible for keeping your device secure and, if you add an email address, for keeping it accurate so we can verify and recover your account. You can delete your account at any time from inside the app, which permanently removes your account data.
3. Tokens
- Tokens are a virtual good used inside DeeMusiq. They are not electronic money, not legal tender, have no cash value and cannot be exchanged for cash.
- Token purchases are non-refundable except where a refund is required by applicable law (including South African consumer protection law).
- Token pricing and what tokens can be spent on may change. Tokens are forfeited if your account is deleted or terminated for abuse, except where the law requires otherwise.
4. Payments
Payments are handled by third-party processors (PayFast, Stripe and NOWPayments for cryptocurrency). Your use of those processors is subject to their own terms. Cryptocurrency payments are confirmed on the relevant blockchain and cannot be reversed by us once sent.
5. Acceptable use
You agree not to:
- Use the service to infringe copyright or any other rights of artists or rights holders.
- Probe, attack, overload, scrape or otherwise interfere with the service or its backend.
- Circumvent payment, token or security mechanisms, or exploit bugs for gain.
- Use the service for anything unlawful, including fraud or money laundering.
6. Content and ownership
Music and artwork on the platform remain the property of their artists and rights holders. The DeeMusiq name, logo, app and website are proprietary to DeeMusiq and its respective owners; the app is built on an open-source Spotube fork whose licence terms are respected and acknowledged in the app.
7. Termination
We may suspend or terminate accounts that breach these terms, abuse the service or harm other users or artists. Where reasonable, we will warn you first. You may stop using the service and delete your account at any time.
8. Disclaimers and liability
The service is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by applicable law, DeeMusiq is not liable for indirect or consequential losses arising from your use of the service. Nothing in these terms excludes rights you have under South African consumer protection law that cannot be excluded by agreement.
9. Governing law
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.
10. Changes to these terms
If these terms change, the updated version will be posted on this page with a new effective date. Continued use of the service after a change means you accept the updated terms.
